TERMS & CONDITIONS – INTEREST-FREE PAYMENT PLANS
THESE TERMS FORM A LEGALLY BINDING CONTRACT. BY SELECTING OR ACCEPTING AN OZ HOME HUB PAYMENT PLAN YOU AGREE TO THE FOLLOWING.
1. PARTIES
“OZ Home Hub”, “we”, “our”, “us” – of 21/38-44 Elizabeth St, Wetherill Park NSW 2164.
“You”, “your” – the customer named on the Sales Order / Online Order Confirmation.
2. DEFINITIONS
- Agreement: These Terms together with the relevant Sales Order / Online Order Confirmation.
- Goods: All products supplied under this Agreement.
- Installment Plan: An interest-free schedule of payments offered by us from time to time.
- Plan Details: Deposit amount, number of installments, installment amounts and due dates shown at checkout or advised by our representative and confirmed in writing.
- Due Date: Each date on which a payment is scheduled to be debited.
- Payment Method: The debit/credit card or other facility you nominate and authorise us to debit.
3. ELIGIBILITY & ASSESSMENT
- You must be 18 years or older, an Australian resident and the authorised holder of the Payment Method.
- You consent to us making any inquiries (including credit checks) we consider necessary.
- Approval of an Installment Plan is at our sole discretion.
4. PLAN OPTIONS & AMOUNTS
- Current Installment Plans, together with all Plan Details, are displayed:
- on the product/checkout pages of our website; or
- verbally by our sales representative and confirmed in writing (email or SMS).
- We may vary or introduce Installment Plans for future orders at any time. A variation does not affect a Plan already accepted by us.
5. AUTHORISATION TO DEBIT
- You irrevocably authorise us to debit the Payment Method for each amount shown in the Plan Details on or after each Due Date without further notice.
- If a Due Date falls on a weekend/public holiday, we may debit on the next or preceding business day.
- You are responsible for ensuring sufficient cleared funds are available.
6. DELIVERY, RISK & TITLE
- Delivery occurs in accordance with our standard Delivery Terms.
- Risk in the Goods passes to you on delivery.
- Title remains with us until all amounts owing under the Plan are received in full.
7. DEFAULT
- You must pay each installment in full on or before its Due Date.
- If any installment is outstanding 14 days after its Due Date or you become insolvent or bankrupt, we may:
- declare all remaining installments immediately due and payable; and/or
- take enforcement action including but not limited to referral to a collections agency, reporting the default to credit-reporting bodies and commencing legal proceedings.
- You agree to pay all reasonable costs we incur in recovering amounts owing (including internal administration, external collection costs and legal fees on an indemnity basis).
8. DISPUTES & SET-OFF
- The Installment Plan is a method of payment only. You must not cancel, stop or reverse any installment because of a dispute regarding the Goods (quality, delay, warranty, etc.).
- Disputes will be managed in accordance with Australian Consumer Law and our Returns & Warranty Policy, but all payments must continue while a dispute is investigated.
- You must not set-off or deduct any amount without our prior written consent.
9. EARLY REPAYMENT & VARIATION
- You may pay the outstanding balance at any time without penalty.
- We may agree (but are not obliged) to vary a payment schedule on your written request. A variation is effective only when confirmed by us in writing.
10. CREDIT REPORTING & PRIVACY
- We handle personal information in accordance with our Privacy Policy.
- You consent to us:
- obtaining credit reports about you;
- disclosing to credit-reporting bodies any default or serious credit infringement; and
- exchanging information with other credit providers where lawful.
11. ASSIGNMENT
We may assign, novate or transfer our rights (including any debt) under this Agreement without notice. You must not assign your rights or obligations without our written consent.
12. LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits any guarantee, condition or warranty imposed by the Australian Consumer Law (ACL) that cannot be excluded. Subject to the ACL, our liability is limited, at our option, to repairing or replacing the Goods or paying the cost of doing so.
13. VARIATION OF TERMS
We may amend these Terms at any time by publishing an updated version on our website. The amended Terms apply to Installment Plans entered after the effective date. Existing Plans remain governed by the version in force when they were made unless both parties agree otherwise in writing.
14. GOVERNING LAW & JURISDICTION
These Terms are governed by the laws of New South Wales, Australia. The parties submit to the non-exclusive jurisdiction of the courts of NSW and of the Commonwealth of Australia.
15. NOTICES
We may give notices by email, SMS, post or any other contact details you provide. A notice is deemed received on the date of transmission (email/SMS) or 3 business days after posting.
16. SEVERABILITY
If any provision of these Terms is held invalid or unenforceable, that provision will be severed and the remaining provisions remain in full force.
17. ENTIRE AGREEMENT
These Terms constitute the entire agreement between the parties regarding Installment Plans and supersede all prior representations or agreements.
BY SELECTING “PAY VIA INSTALLMENTS”, SIGNING THE ORDER FORM, OR OTHERWISE PROVIDING CONSENT, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD AND AGREE TO BE BOUND BY THESE TERMS & CONDITIONS.
